The office can lower or raise the table amount by up to half, considering your age and situation, why it happened and its result, your ability to pay, and how many times it has happened. A repeat within 3 years can make it higher. In unavoidable cases, with the Minister of Justice's approval, the office can set a different amount.

3. What else the law says

  • Maximum in the Act: a fine of up to 1,000,000 won.
  • If you pay the fine as notified, you can't be punished again for the same case.
  • The Minister of Justice can waive the fine, considering your age, situation, motive and ability to pay.
  • After a fine, the immigration office can also order you to leave Korea if it finds that appropriate.

Common questions

Do I have 14 or 15 days to report a new address?

15 days from the day you move in, if you have an ARC. The move-in day is not counted: if you moved in on October 1, the deadline is October 16. The deadline was 14 days until December 2020, so some older pages still say 14. Overseas Koreans who reported a domestic residence (F-4) have 14 days under a different law.

How much is the fine for reporting my address late?

In the official table: 100,000 won for less than 3 months late, 300,000 won for 3 to 6 months, 500,000 won for 6 months to 1 year, 700,000 won for 1 to 2 years, and 1,000,000 won for 2 years or more. The immigration office can lower or raise it by up to half and decides the final amount.

Can I report a late address online or at the community center?

No. After the 15 days, the report can't be made online, and you have to report at the immigration office for your new address. Book a visit on HiKorea, or call 1345 to ask how your office takes late reports.

Will a late report or a fine affect my visa extension or permanent residency?

This page can't answer that. The fine tables don't say, and we could not find an official rule on how past fines count in later applications. Call 1345 before you apply.

My stay ends before my appointment date. Will I be overstaying?

Apply before your stay ends. A HiKorea visit booking is only an appointment, not an application. HiKorea asks you to book a date before your stay ends, and says a fine may be charged if you visit after it. If no date is free, visit the immigration office before your stay ends. Online extension is open only for some visa types, from 120 to 3 business days before your stay ends. Otherwise, book a visit, up to the day before your stay ends.

What is the fine for overstaying? Some sites say 200,000 won for less than a month.

200,000, 500,000, 1,000,000 and 2,000,000 won are the official amounts for not registering for an ARC. For staying past your permitted stay without an extension, the table starts at 500,000 won for less than 1 month, then 1,000,000 won for 1 to 3 months, 2,000,000 won for 3 to 6 months and 5,000,000 won for 6 months to 1 year, up to 30,000,000 won for 7 years or more.

Do I report my new address at the community center or the immigration office?

Either one, if you are within the 15 days. You don't need to report at both: the office that takes your report notifies the other.

I got a new passport. Do I have to report it?

Yes, within 15 days, if you have an ARC. If only the passport number, issue date or expiry date changed, you can report online on HiKorea for free. If your name, date of birth or sex changed, report in person at the immigration office.

Is the fine lower if I come forward myself or it's my first time?

There is no fixed discount for coming forward or for a first time. The office can lower or raise the table amount by up to half, looking at your age and situation, why it happened, your ability to pay and how many times it has happened. For the administrative fine for a late passport report, the law also allows a cut of up to 20% if you pay within the notice period, and up to 50% for minors and some other groups.

What happens if I don't pay?

For a late address report, a late ARC registration or an overstay, the fine comes on a written notice. You must pay within 15 days of receiving it. If you don't, the immigration office must file a criminal complaint, unless you pay before it does. Once you pay as notified, you can't be punished again for the same case.

Can I be deported or banned from coming back?

For not registering for an ARC or overstaying, the Act allows deportation, and after a deportation Korea can refuse entry for 5 years. After any fine, the office can also order you to leave Korea if it finds that appropriate. We could not find official rules on other entry bans, so ask 1345 about your case.

Does my address report matter for my rental deposit?

Yes. Under the Immigration Act, your change-of-residence report counts as the move-in report (jeonip singo) that Koreans make. Korea's tenant protection law starts protecting a lease the day after you have moved in and made that report, so report on time if you paid a deposit.
